The Supreme Court has postponed the hearing on the petition against the High Court’s decision to put an interim stay on the bail of CM Arvind Kejriwal in the money laundering case related to the alleged liquor scam in Delhi till June 26. The vacation bench of Justice Manoj Mishra and Justice SVN Bhatti said that the decision of the High Court should be awaited on this issue. During the hearing, when Abhishek Manu Singhvi, appearing for Kejriwal, questioned the High Court’s decision to stay the bail, the bench made a strong comment.

In fact, during the hearing, Singhvi said, once bail was granted, the High Court should not have stayed the bail. He said, if the High Court had overturned the order, Kejriwal would have gone to jail again. But he was stopped from coming out through an interim order. If the ED petition is rejected, then how will my (CM Kejriwal’s) time be compensated?

What did the court say on Singhvi’s arguments?

When Singhvi was opposing the interim stay of the High Court, the Supreme Court made an important comment. The court said that the decision regarding the stay on bail comes immediately, it is not kept pending. This is unusual. The bench said, the High Court has made it clear that the order will come soon. Singhvi said, by then I should have been out. During this, ED told the judges that the order of the High Court will come by tomorrow or day after.

The ED arrested Arvind Kejriwal on March 21. Recently, the ED arrested Kejriwal Lok Sabha Elections The court had given interim relief till June 2 for campaigning in the assembly. The court had also directed Kejriwal to approach the lower court for bail. After this, Kejriwal surrendered on June 2. He is currently lodged in Tihar Jail.

The lower court had granted bail to Kejriwal on his plea. However, the ED had challenged this decision in the High Court. The High Court had put an interim stay in this case. Kejriwal has challenged the High Court’s decision to put a stay in the Supreme Court.
